Privacy Policy

1. Overview

This Privacy Policy describes how Auto City Sales & Leasing (“Auto City,” “we,” “us,” or “our”) collects, uses, discloses, and protects information when you visit autocitysale.com (the “Site”) or otherwise interact with us to request or complete the sale of a vehicle. This Policy is designed to comply with the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the California Online Privacy Protection Act (CalOPPA), the California Invasion of Privacy Act (CIPA), and the federal Telephone Consumer Protection Act (TCPA), among other applicable laws.

We collect this information directly from you when you submit the offer form, call or text us, or communicate with our team; automatically through cookies and similar technologies when you browse the Site; and, where applicable, from third parties such as lienholders, lenders, or vehicle history/valuation data providers to verify information you have provided. We retain each category of personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy, satisfy tax and recordkeeping obligations related to vehicle purchases (generally up to seven years), or as otherwise required by law, after which it is securely deleted or de-identified.

3. How We Use Information

  • To generate and provide vehicle offers and estimates;
  • To schedule and conduct inspections and appraisals;
  • To verify vehicle title, lien, and payoff information with lenders, lessors, and the DMV;
  • To process accepted transactions, including payment, odometer disclosure, and title transfer;
  • To communicate with you by phone, text, or email about your offer, appointment, or transaction, consistent with Section 8 below;
  • To improve, secure, and analyze use of the Site, and to detect and prevent fraud;
  • To comply with legal, tax, and regulatory recordkeeping obligations related to vehicle purchases.

We do not use sensitive personal information to infer characteristics about you, and we limit our use of sensitive personal information to the purposes necessary to complete your transaction and satisfy legal recordkeeping requirements, as permitted under the CPRA without requiring an opt-out.

4. Cookies, Analytics & Tracking Technologies

The Site may use cookies and similar technologies, including analytics tools (such as Google Analytics) and advertising/conversion pixels (such as the Meta/Facebook Pixel), to understand Site usage, measure advertising effectiveness, and improve performance. You can control most cookies through your browser settings; disabling cookies may affect certain Site functionality. Do Not Track: Our Site does not currently respond differently to browser “Do Not Track” signals. Global Privacy Control: Where technically supported, we treat a validly enabled Global Privacy Control (GPC) browser signal as a request to opt out of the sale or sharing of personal information for the browser and device from which it is sent, as required under the CPRA.

5. How We Share Information

We do not sell your personal information to third parties in exchange for money. We may disclose or make available (which may be considered “sharing” under the CPRA if for cross-context behavioral advertising) information with or to:

  • Service providers who support our operations under written contracts limiting their use of your information, such as payment processors, appraisal and inspection partners, transportation/towing providers, IT and hosting vendors, and analytics or advertising platforms;
  • Lenders or lessors, where necessary to verify or process a loan or lease payoff on your vehicle;
  • Government or regulatory authorities, where required by law, such as DMV title-transfer filings, tax reporting, or in response to a valid legal request;
  • Professional advisors, such as attorneys, accountants, and insurers, as needed;
  • Successors, in connection with a merger, acquisition, financing, or sale of business assets.

If our use of analytics or advertising cookies constitutes a “sale” or “sharing” of personal information under the CCPA/CPRA, you may opt out as described in Section 7 below.

6. Text Messages & Calls (TCPA)

By providing your phone number, you consent to receive calls and text messages from Auto City related to your offer and transaction, which may be sent using automatic telephone dialing systems or prerecorded/artificial voice technology, consistent with the federal Telephone Consumer Protection Act. Message and data rates may apply, and message frequency may vary. Consent to receive autodialed or automated calls and texts is not a condition of any purchase. Reply “STOP” to any text message to opt out of texts at any time, or contact us using the details in Section 15 to opt out of calls.

7. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you the right to:

  • Know/Access — request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business purpose for collecting it, and the categories of third parties with whom it is shared;
  • Delete — request deletion of personal information we have collected from you, subject to certain exceptions (for example, information we must retain to complete a transaction, comply with a legal obligation, or exercise a legal claim);
  • Correct — request correction of inaccurate personal information we maintain about you;
  • Opt Out — opt out of the “sale” or “sharing” of your personal information, to the extent applicable;
  • Limit — limit the use or disclosure of sensitive personal information to purposes permitted under the CPRA without additional consent;
  • Non-Discrimination — not be denied goods or services, charged a different price, or provided a different level or quality of service for exercising any of these rights;
  • Appeal — appeal a denial of a rights request, using the contact information below.

We will verify your identity using information reasonably necessary to match you to your records (which may include your name, phone number, email, and vehicle/transaction details) before fulfilling know, delete, or correct requests, and may deny a request we cannot verify. You may designate an authorized agent to submit a request on your behalf by providing us with written proof of the agent’s authority; we may still require you to directly verify your identity. We will respond to verifiable requests within the time required by law (generally 45 days, extendable once by an additional 45 days with notice to you).

Shine the Light. Separately from the CCPA, California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure, if any, of personal information to third parties for their own direct marketing purposes in the preceding calendar year. We do not disclose personal information to third parties for their own direct marketing purposes; if this changes, we will describe the applicable request process here.

8. Communications Preferences

You may opt out of marketing text messages at any time by replying “STOP,” and may unsubscribe from marketing emails using the unsubscribe link included in each message, consistent with the federal CAN-SPAM Act. Opting out of marketing communications does not affect transactional or service messages necessary to complete an active offer or transaction.

9. Call Recording Notice (CIPA)

California is a two-party (all-party) consent state under the California Invasion of Privacy Act (Cal. Penal Code § 632). If Auto City or its service providers record a telephone call with you for quality assurance, training, dispute resolution, or compliance purposes, you will be notified of the recording at the outset of the call.

10. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, disclosure, alteration, or destruction, including access controls, encryption in transit for sensitive submissions, and limiting employee access to personal information on a need-to-know basis. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Data Breach Notification

In the event of a breach of the security of our system that compromises your unencrypted personal information, we will notify affected California residents in the most expedient time possible and without unreasonable delay, consistent with California Civil Code Section 1798.82, and will provide the information required under that statute.

12. Children’s Privacy

The Site is not directed to individuals under 18, and we do not knowingly collect personal information from children under 13 (or under 16 for purposes of selling or sharing personal information, consistent with the CCPA). If you believe a child has provided us with personal information, please contact us so we can investigate and delete it as appropriate.

13. Third-Party Links

The Site may link to or embed third-party services (for example, valuation tools, payment processors, or mapping services). This Policy does not apply to those third-party services, and we encourage you to review their respective privacy policies.

14. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. Material changes will be reflected by an updated “Effective date” above, and, where required by law, we will provide additional notice. We encourage you to review this page periodically.
